Criminal Cases Against BJP Candidates – Reality Check

BJP has come out with its list of candidates. Some people are cribbing that many of these have criminal cases against them. This report from IBN  says BJP has 23 out of 62 candidates with criminal cases.

I did an analysis on these cases and most of them are frivolous/political cases. Lets look at some of the serious cases:

Murder charge:

  • Sarbananda Sonowal of BJP from Lakhimpur, Assam
    Had a murder charge pending since 1986 for murder of a student leader. This charge was finally quashed by HC on June 26, 2012. But this case is still counted as the “analysis” done by IBN uses data from last affidavit filed during last elections. And in 2009, the case was still pending.

Kidnapping Charge:

  • Gopinath Munde: Did Munde kidnap someone, kept in confinement, ask for ransom? This is what seems when you hear of a kidnapping case, right?
    So lets look at the actual charge against Munde. The charge is by Congress MLA Padmakar Valvi that in June 2003 Gopinath Munde & Shiv Sena’s Rane prevented him from going to assembly for a vote of confidence.
    Does this really qualify as a kidnapping case?? But Munde has to report this on his affidavit as a pending charge till this case comes to closure. Which knowing the Indian judicial system, we all know may well never come.
